If a complaint is dismissed due to insufficient evidence, the complainant (person who submitted the complaint) may request a review of that decision within 30 days of receiving notice of dismissal from the Complaints Director.
Complaint Review Process
- A Complaint Review Committee (CRC) is created from a list of volunteer regulated practitioners. The complainant and investigated practitioner are invited to attend and make representations.
- The CRC is provided with a copy of the preliminary investigation report as well as reasons of Complaints Director/Chair in making their decision.
- If it is determined that the matter must go to hearing, a Hearing Tribunal consisting of three different practitioners from the membership list will sit on the hearing.
The only decision to be made by the CRC is whether the complaint should proceed to hearing or confirm there is insufficient evidence to proceed, providing written reasons for the decision. The onus of proof in a complaint review is on the complainant, who shall present evidence to establish that the matter ought to proceed to hearing.
