There are two points at which the appeal process may be accessed.
Findings of the Hearing Tribunal
The complainant or investigated practitioner may appeal a finding or order of the Hearing Tribunal. The appeal must be submitted in writing to the Health Disciplines Board:
- Within 30 days of receiving notice of the decision and order; and
- Describe the finding or order, or both, being appealed and states reasons for the appeal.
The appeal to the Health Disciplines Board is founded on the record of the hearing and the investigated practitioner, complainant and the College may attend and be represented at the appeal.
On conclusion of the appeal, the Health Disciplines Board may:
- Confirm, vary or dismiss the findings or orders of the Hearing Tribunal;
- Make any finding it believes the Hearing Tribunal ought to have made; or,
- Refer the matter back to the Hearing Tribunal for further consideration.
The decision of the Hearing Tribunal remains in effect until the Health Disciplines Board makes a decision on an appeal.
Findings of the Health Disciplines Board
The complainant, investigated practitioner or the Alberta College of Paramedics may appeal the decision of the Health Disciplines Board. The appeal must be made within 30 days following the release of a decision by the Health Disciplines Board.
The Courts may:
- Confirm, vary or dismiss the decision of the Board;
- Make any finding or order it believes ought to have been made;
- Refer the matter back to the Board for further consideration; or,
- Refer the matter to the Alberta Court of Queen's Bench.
